Navajo Ranch Marijuana Regulations
At the January 6th, 2016 HOA Board Meeting, the Officers adopted and approved new regulations concerning the use of marijuana in Navajo Ranch. Authority for such action is granted in Article II, page 1 of the Navajo Ranch By-Laws in Herfano County.
Use of marijuana in Navajo Ranch is allowed in accordance with State of Colorado and Amendment 64, whichg reads as follows;
POSSESSING, GROWING, PROCESSING, OR TRANSPORTING NO MORE THAN SIX MARIJUANA PLANTS, WITH THREE OR FEWER BEING MATURE, FLOWERING PLANTS, AND POSSESSION OF THE MARIJUANA PRODUCED BY THE PLANTS ON THE PREMISES WHERE THE PLANTS WERE GROWN, PROVIDED THAT THE GROWING TAKES PLACE IN AN ENCLOSED, LOCKED SPACE, IS NOT CONDUCTED OPENLY OR PUBLICLY, AND IS NOT MADE AVAILABLE FOR SALE.
Note: There is no distinction between recreational and medicinal use as to number of plants.
What is Not Allowed/Permitted in Navajo Ranch
- No growing for the purpose of commercial sales, transporting and or distribution
- No selling of marijuana or any other illegal/illicit drug
- Smoking or any other illegal drug activity is not permitted in the following areas of Navajo Ranch; water district parking lot, all green belt areas (property seperating individual lots), mail box parking areas, areas surrounding Kiosks, parking areas at buildings at CR510 and hwy 160.
SALE OF MARIJUANA OR ANY OTHER ILLEGAL DRUG IS A STATE CRIME AND IS EITHER A MISDEMEANOR OR A FELONY DEPENDING ON THE AMOUNT SOLD
VIOLATORS OF THE ABOVE STATED RULES WILL BE PROSECUTED TO THE FULL EXTENT OF THE LAW AND ALL LEGAL RECOURSE AVAILABLE TO THE NAVAJO RANCH HOMEOWNER’S ASSOCIATION

“Terms and conditions of several pertinent court decrees limit water usage, from Wanter District source, to be in-house use only, with NO irrigation, including lawn and garden irrigation,on any of the lots“, Violators of this regulation are subject to water service being disconnected.
